PROFILE

As a senior member of the global Conflicts Team, the Conflicts Lawyer will carry out and oversee the process of global firm conflict checks and analysis necessary to approve new clients and matters; generally involving conflicts and confidentiality issues. This position will assist the Counsel, Conflicts and Regulatory Matters in supervising the other members of the Client and Matter Acceptance Team (CAMAT).

This position will also support our General Counsel and our Conflicts Partner, on a variety of other conflicts and risk management issues.

This position can be based in any of the following Gowling WLG offices:   Vancouver, Calgary, Hamilton, Toronto, Ottawa, and Montreal.

RESPONSIBILITIES

  • Analyzing and evaluating global conflicts search results, working with our global offices’ conflicts teams, reporting findings to the requesting professional, and identifying resolutions for potentially complex legal, ethical, and business conflict of interest issues.
  • Assessing and responding to conflict referrals from our global offices and drafting responses.
  • Using internal and external databases and other legal resources to research conflict identification, obtaining necessary information on the nature of an entity’s role in a particular matter and identifying relevant corporate affiliations.
  • Contributing to the development and improvement of the CAMAT, including streamlining work flow processes and software enhancements to upgrade our integrated global operation.
  • Analyzing trends in file openings and conflict of interest issues, to assist in the further automation of our processes.
  • Reviewing and analysing conflicts searches as part of the process of lateral recruitment in Canadian offices.
  • Advise on, and determine the need for client disclosure and ethical walls, and preparing appropriate disclosure and waiver letters, if needed.
  • Working with professionals on analysis of clients’ outside counsel guidelines.
  • Assisting the General Counsel with other risk management and commercial contract matters as required.

QUALIFICATIONS

  • Three (3) years’ experience working as a lawyer, preferably in a large, business law firm environment.
  • Proficient knowledge regarding the various provincial Rules of Professional Conduct and case law concerning fiduciary duties and conflicts, familiarity with key elements of conflict clearance and law firm file intake requirements.
  • Knowledge of corporate legislation and structures, and an understanding of business law, intellectual property and advocacy matters.
  • Previous experience in conflicts and file intake an asset.
  • Strong interpersonal skills, and the ability to guide a team and influence multiple key stakeholders and peers in order to accomplish common objectives.
  • Strong analytical and problem solving skills with the ability to exercise sound judgment.
  • Proficient with technology, including databases and Excel.
  • Strong organizational skills and the ability to deal with time pressures and changing priorities in a professional manner.
  • Capacity to work independently, as well as co-operatively in an agile/virtual team environment, and to ensure consistency and consensus in response.
  • Flexibility to work some additional hours as business needs dictate.
